PORT WARE INDIAN BAND BY-LAW NUMBER 2-1986 A BY-LAW TO REPEAL BY-LAW NUMBER 1-1985 BEING AN INTOXICANTS BY-LAW WHEREAS the Council of the Fort Ware Indian Band did enact By-Law Number 1-1985 on December 9th, ,1985, pursuant to section 85.1 of the Indian Act, to protect its residents from the presence of intoxicants on its reserve lands; AND WHEREAS although this by-law was properly enacted and registered, it was never published in the Canada Gazette, nor was it exempted from publication; and as a result of this, the Band is prevented from obtaining convictions for breaches thereof that occurred since registration of this By-law. It is the opinion of the Band Council of the Fort Ware Indian Band that our By-Law No. 1-1985 is therefore unenforceable; NCW THEREFORE the Council of the Fort Ware Indian Band enacts as a by-law thereof the following: 1. By-law number 1-1985 enacted on December 9th, 1985 and being an intoxicants by-law be and the same is hereby repealed. Approved and passed at a duly convened meeting of the council of the Fort Ware Indian Band held on "November" "24", 1986. AND THAT this by-law, prior to enactment by the Band Council of the Fort Ware Indian Band, was first assented to by a majority of the electors of the Band who voted at a special meeting of the band held on "November 24" , 1986 and called by the council of the band for the purpose of considering this by-law. PAGE TWO Be it known that this by-law shall be known as the "Intoxicants Repealing By-Law" and is consented to by the following members of the band council: "Emil McGook" CHIEF _____"Johnny Poole" COUNCILLOR _____"Melvin McCook" COUNCILLOR _____"Faye Seymour" COUNCILLOR AND being a majority (or more) of those members of the Council of the Fort Ware Indian Band present at the above-mentioned meeting.
