"CERTIFIED" GITSEGUKLA BAND OF INDIANS BY-LAW NUMBER 90-4 Being A By-Law Respecting The Observance Of Law And Order And The Prevention Of Disorderly Conduct And Nuisances. WHEREAS Section 81(1)(c) of the Indian Act .R.S.C. 1970,c. 1-6 as amended, empowers the Council of a Band to make a by-law for the observance of law and order; AND WHEREAS Section 81(1)(d) of the Indian Act, R.S.C. 1970,c.1-6 as amended, empowers the Council of a Band to make a by-law for the prevention of disorderly conduct and nuisances; AND WHEREAS the Band Council deems it in the best interest and welfare of the Gitsegukla Village to maintain the observance of law and orderly conduct on the reserve; THEREFORE the Gitsegukla Band Council hereby enacts as follows; No person present on the reserve shall act in a way which, in the opinion of a Band Council member is; (a) disruptive, disorderly or detrimental to the best interests and welfare of the Gitsegukla Village, or (b) a criminal offence or an offence under the laws of the laws of the Province of British Columbia. Anyone who violates any provision of this by-law may be liable to a fine not exceeding $50.00 or a period of community service or both. Any person who is not a member of the Gitsegukla Band and who, in opinion of a Band Council member, violates any provision of this by-law may be required by any Band Council member to immediately leave the reserve and/or to remain off the reserve
"CERTIFIED" for a specified period of time. Failure to immediately leave the reserve or to remain off the reservepursuant to a direction from a Band Council member shall constitute an offence under this By-Law.
