Y C - ^ '^ r v By Law No 1997-D01 A By-Law Respecting Animal Control The Gitanyow Band 9 56 7 '97 AVR15 12:42 WHEREAS section 81, paragraphs (a), (d), (e), (q) and (r), o f the Indian Act empower the Council o f a Band of Indians to pass by-laws to provide for the health o f residents on the reserve, the prevention of nuisances, the protection against and prevention of trespass by domestic animals, matters arising out of or ancillary to the exercise of powers under this section, and the imposition of a penalty for the violation o f any such by-law; AND WHEREAS the Council deems it to be expedient and in the best interest, health and safety o f the residents o f the Gitanyow to enact a by-law respecting Animal Control; NOW THEREFORE the Council o f the Gitanyow Band enacts as a by-law therof as follows: (1.) Every owner of a dog shall keep the dog safely tethered or penned up at all times. (2.) A dog need not be tethered or penned up as provided in subsection (1) if the dog: (a) is held on a leash by a person capable o f restraining the dogs movements; (b) is being used by a person for the purpose o f hunting; (c) is being used by a person to work in lawful manner with sheep or cattle; or (d) is used by a visually impaired person as a guide dog. (3.) Any dog not tethered or penned up will be considered stray and may be destroyed. The procedures in which the stray dog will be destroyed is as follows: (a) the Band staff will contact the local Animal Shelter *• (b) the dog will be put down by injection and disposed o f by the Animal Control officer from the shelter. (4.) All owners o f dogs must register their dogs with the Band. Upon registration pay a licensing fee. The licensing fee will be posted at the Band Office. Upon registration, each owner will receive a dog tag which must be renewed every six months. Any dog without a new dog tag will be considered stray. All funds from the dog tag program will be used to pay expenses such as dog tags and to destroy stray dogs. (5.) All owners are responsible for their dog. Any dogs causing nuisance or harm to the residents of Gitanyow will be subject to disposal.
THIS BY-LAW IS HEREBY made at a duly convened meeting o f the Council o f theXSitanyow Band this 25 day o f March, 1997.
