Exhibit "A" THE LYTTON BAND OF INDIANS BY-LAW #1978 - 1 B a e n i d ng O ff a -H B i y g h L w a a w y t v o eh re i g c u l l e a s t . e the use of Recreational Whereas sections 81 (b) (c) (d) (g) and (r) of the Indian Act empowers the Council of a Band to make by-laws respecting the regulation of traffic, the observance of law and order, the prevention of disorderly conduct and nuisances, and any matter ancillary thereto, and the imposition of a penalty for the violation thereof; And Whereas the use of Off-Highway vehicles within the Reserve creates a nuisance and danger; And Whereas the Council has received numerous requests from the residents of the Lytton Indian Reserve to regulate the use of certain vehicles; Now Therefore the Council of the Lytton Band of Indian enacts as a by-law thereof as follows: 1. In this by-law, unless the context otherwise requires; a) "all terrain vehicle" has the same meaning as in the All Terrain Vehicles Act RSBC 1971, chapter 3; b) "Council" means the Council, as defined in the Indian Act, of the Lytton Band of Indians; c) "Highway", "Motorcycle", and Motor "Vehicle" shall each have the same meaning respectively as in the Motor Vehicle Act, RSBC 1960, chapter 3; d) "Off-Highway vehicle" means any type of vehicle propelled by motorised power and capable of travel on or off a highway and without limiting the generality of the foregoing shall be deemed to include motorcycle, motor vehicle and all terrain vehicles; and .e) "Reserve" means those tracts or parcels of land set apart for the use and benefit of the Lytton Indian Band which are known as the Lytton Indian Reserves No. 1 and No. 15. 2. No person shall operate, or authorize or permit any person to operate, an off-highway vehicle within the limits of the reserve except on a highway. Any person who violates any of the provisions of this by-law shall be guilty of an offence, and shall be liable, on summary conviction to a fine not exceeding $100.00 or imprisonment for a term not exceeding 30 days or to both fine and imprisonment.
