CAPE MUDGE BAND OF INDIANS BY-LAW NO. 12.1978 BEING a BY-LAW to Regulate the Discharge of Firearms WHEREAS it is deemed to be expedient to limit the discharge of fire­ arms on the lands set aside for the Cape Mudge Band of Indians. NOW THEREFORE the Council of the Cape Mudge Band of Indians enacts as a By-Law thereof the foil owing:-1. In this By-Law:-(a) "Reserve" means a tract of land, the legal title to which is vested in Her Majesty, that has been set apart by Her Majesty for the use and benefit of the Cape Mudge Band of Indians known as the 'CapeMudge Band,' specifically including Village Bay Indian Reserve No. 7, Open Bay Indian Reserve No. 8, Drew Harbour Indian Reserve No. 9, Cape Mudge Indian Reserve No. 10, and Quinsam Indian Reserve No. 12. (b) "Firearms" means rifles, guns, spring guns, air guns, revolvers, pistols, or any device designed to propel any object or missile in a manner similar to the method used in rifles or shotguns, revolvers, pistols, spring guns, or air guns of any kind or make. 2. It shall be unlawful for any person to discharge firearms of any kind or calibre within the reserve except as hereinafter provided. 3. Notwithstanding Clause 2 of this By-Law, persons duly author­ ized to destroy predatory animals or perform any other law­ ful duty, may obtain a permit for the use of firearms within the reserve boundaries from the Cape Mudge Indian Band Council. 4. Any person who violates any of the provisions of this By-Law shall be guilty of an offence, and shall be liable on summary conviction to a fine not exceeding $100.00 or imprisonment for a term not exceeding thirty (30) days, or both fine and imprison­ ment.
