JT| YUKON TERRITORY DIDPOSAL OF GARBAGE BY-LAW The Council o f the L /FH?A _________Band o f Ind ians a t a meeting th is ;-\TT\ day of T-rV> " 19 hereby enacts by-law number ______ _ to provide fo r the reg u la tio n o f the di sposal o f garbage waste. Whereas Paragraph (a) and ( r ) o f Section 81 o f the Ind ian Act empowers the Council o f a band to make by-law to provide fo r the hea lth o f res iden ts in the Reserve and to p revent the spreading o f contagious and in fe c tio u s diseases and the im pos ition of pena lty fo r a v io la t io n the reo f, and, Whereas i t is deemed to be exped ient to con tro l the d isposal o f garbage and waste fo r the hea lth and w e lfa re o f the in hab ita n ts o f the Now the re fo re the Council o f the / 'M A O _____________ Bands of Ind ians enacts as a by-law the reo f the fo llo w in g : 1. In th is by-law: (a) "Counc il" means the Council as defined in the Ind ian Act. (b) "Reserve" means the t ra c t o f land se t apa rt by Her M ajesty w ith in the d e f in it io n o f the Ind ian Ac t, fo r the use and b e n e fit o f the k j Hv?o T il Band o f Ind ians known as the T :x . ^ .■_________________ . (c) "Prem ises" means lands and residences w ith in the Reserve. 2. No person s h a ll accumulate or pe rm it to be accumulated upon premises in h is possession o r deposit o r accumulate on premises in possession o f another person anyth ing which is o r may become o ffens ive o r in ­ ju r io u s to hea lth . 3. No person s h a ll deposit any dead anam il, o f fa l f is h , manure, garbage, f r u i t , vegetab les, n ig h t s o i l , f i l t h , l iq u id waste, human e xc re tio n , o r anyth ing of a nature which is o r may become o ffens ive o r p re­ ju d ic ia l to hea lth upon o r in to any highway, s t re e t , road, a l le y , lane, lo t , d itc h , w harf, dock, pond, r iv e r , stream , w e ll, o r sewer o r in to and premises w ith in the Reserve and any such deposit s h a ll be deemed a nuisance, provided, however, th a t the p ro v is io n o f th is paragraph s h a ll not apply to the deposit and proper d isposal o f any such waste and m a te ria l in to o r a t a place w ith in the Reserve approved by the Council fo r th a t purpose. 4. The Council may arrange fo r a re g u la r removal o f garbage and waste from any premises w ith in the Reserve. 5. In the sp ring of each ye a r, as soon as the m e lting o f snow prem its the person re s id in g in any premises w ith in the reserve s h a ll c o lle c t a l l waste m atte r ly in g thereon in c lud ing t in cans, b o t t le s , paper and animal manure. 6. A l l such waste m atte r s h a ll be disposed o f in such a manner as w i l l p revent any nuisance o r offence as the fo u lin g o r p o llu t in g o f w e lls and wate r supply. 7. Any person who v io la te s any o f the p rov is ions of th is by-law s h a ll be g u i l t y o f an offence and s h a ll be l ia b le on a summary con­ v ic t io n o f a f in e not exceeding $100 o r imprisonment fo r a term not exceeding 30 days o r both f in e and imprisonment.
