rcgcrve //8 YUKON TERRITORY CAMPING BY-LAW The Counci l of the Whit.ehorse Bond of Indians at a meet ing he ld th i s 2i rd day of November f 19^^ hereby enac ts by- law number 4 t.o prov ide f or the r e g u l a t i o n of access to camping areas and camping u/ithin the boundar i es of the Whi tehorse Indian Rese rve . Whereas, paragraphs ( p ) and ( r ) of Sec t i on 81 of the Indian Act empowers the Counci l of a Band t o make by- l aws t o prov ide f o r the r e g u l a t i o n of camping and the i mpos i t i on of a penal ty f o r a v i o l a t i o n t h e r e o f , and, j t.Whereas, i t i s deemed t o be expedi ent t o c o n t r o l and r egu l a t e camping areas w i th i n the boundar i es of the Reserve . Now t h e r e f o r e , the Counc i l of the Whi tehorse Band of Indians enacts a by- law t h e r eo f the f o l l o w i n g : 1. In t h i s by - l aw, ( a ) "Counc i l " means the Counci l as d e f i ned in the Indian Act o f the Whi tehorse Band of I nd i ans ; ( b ) "Reser ve " means the t r a c t of land se t apart by Her Majesty wi th in the d e f i n i t i o n of the Indian Ac t , f o r the use and b e n e f i t of the Whi tehorse Band of Indians known as the Whi tehorse Indian Reserve # 8 . ( c ) " Sup e r v i s o r " means a person author i z ed by the Counci l of a Band t o superv i se camping areas and camping on the Reserve . ( d ) "Camping a r ea " means a des i gnated area f o r temporary s t op o v e r s , be i t over ni ght or o t h e r w i s e . 2. No person, other than a member of a Band or the ho lder of a v a l i d camping l e a s e , s h a l l be permi t t ed t o camp or be in possess i on of camping equipment in the Reserve wi thout f i r s t obta in ing a w r i t t e n permit f rom the s u p e r v i s o r . 3. A camping permit s h a l l be v a l i d only f o r the per i od i nsc r i bed thereon and f o r such p laces in the Reserve as are des i gnated as camping areas by the Counci l and may be subj ec t t o a f e e e s t a b l i s hed by Band Counc i l Re s olut i on. A. A l l campers s h a l l abide by the r e g u l a t i o n s of the Yukon T e r r i t o r y made f o r c o n t r o l l i n g f i r e s and the s e t t i n g of f i r e s in lands cont i guous t o the Rese rve . 5. A l l campers sha l l , make arrangements f o r ob ta in ing f i r e wood from the s u p e r v i s o r . 6 . No t imber , g r a v e l , or mineral s h a l l be removed f rom, the Reserve nor may t r e e s be damaged in any way. 7. The Superv i sor may cance l any camping permit where, in hi s opinion the ho lder of such permit has acted in n manner cont rary t o the best i n t e r e s t s of the inhabi t ants of a Band. 8 . No person s h a l l wi thout l aw f u l excuse , the proo f of which l i e s upon him, prowl or l o i t e r by day or by ni ght upon or near the area where a camp s i t e i s l o c a t e d .
9, Any person who v i o l a t e s any 01 by-leur s h a l l be g u i l t y of an o f f e n c e , and s h a l l be l i a b l e t o a summary c o n v i c t i on t o a f i n e not exceed ing $500.00 or imprisonment f o r a term not exceed ing 30 days or both f i n e and imprisonment . Approved and passed at a duly convened meeting of the Counci l of the .Whi tehorse Band of Indians t h i s day of November , 19 79 .
