â jh jty 9 YUKON TERRITORY DOG BY-LAW The Council of the Carcross Tagish Indian_________Band o f in(jians at a meeting held this I/tn day of pecenfcer 19 85 hereby enacts by-law number 5 to provide for the regulation and control of dogs wi thin the boundaries Of Carcross Tagish Indian Band lands . WHEREAS, paragraphs Cal and O Î of Section 81 of the Indian Act empowers the Council of a Band to make by-laws to provide for hea.lth of residents on the Reserve and to prevent the spreading of diseases and the imposition of a penalty for a violation thereof, and, WHEREAS, it is deemed to be expedient to provide for the regulation and control of dogs for the health, safety and welfare of the inhabitants of the Carcross Tagish Tnrh'an Ranrl________• Now therefore the Council of the r^rrmcc T^-ch _______ Band of Indians enacts as a by-law thereof, the foil owing : 1. In this by-law (a) "Reserve" means the tract of land set apart by Her Majesty within the definition of the Indian Act, for the use and benefit of the Carcross Tagish____________ Band of Indians known as the Carcross Tatnsh TnHian r w (b) "Council" means the Council as defined in the Indian Act (c) "Co.nstable" means a person appointed for the pur­ pose of maintaining law and order on the Carcross Tagish Indian Band lands. (d) "Household" means house, abode or any dwelling that is occupied. (e) "Animal" Includes Dog, Mule, Cattle, Goats and horses. (f) a " ni A m t a l L . arge" means off the premises of the owner of the 2. No person shàll establish a kennel on the Reserve to breed dogs without the written consent of the Band Council. 3. No person shall allow his/her dog to run at large within the reserve. 4. No household shall possess more than 2 doq/dogs at any one time. 5. A person or household that owns a dog with a vicious nature shall be responsible to keep that dog under control by having it muzzled or chained at all times. 6. No person shall ill treat by beating, molesting or neglect ing a dog that is tied, chained or otherwise. 7. No person or household shall possess a dog that is not properly collered with a dog tag of ownership. 8. The Constable shall make periodic checks on the amount and kinds of dogs possessed in each household. « 9 . The Constable may destroy any stray dogs, or any group of dogs that could endanger the health and safety of the inhabitants of narrmss Tagish TnrHan Rand Reserve lands.
ZL ê>o VICIOUS ANIMALS 10. For the purpose of this by-law any animal that attacks or bites a person shall be classed as having a vicious temperament. (1) The Constable will immediately seize and may destroy the animal. (2) The animal for rabies control purpose may be quarantined for a period of ten (10) days. The animal will not be: released except with the approval of a medical health officer. (3) The owner may redeem his animal after approval of the medical officer, and all cost incurred throughout these proceedings are paid bv the owner, 11 » owner of an animal shall permit such an animal to run at large, within the "Car-cross fagish Indian Band Reserve Lands. 12. An owner of a dog who refuses or neglects the contents of a written notice within the period of 3 days shall be guilty of a breach of this by-law. 13. Any person who violates any of the provisions of this by-law shall be guilty of an offence, and shall be liable to a summary conviction to a fine not exceeding $ 100-00 or imprisonment for a term not exceeding 30 days or both fine and imprisonment. The quorum for this Band consists of the Chief and 3 Council members.
