DISPOSAL OF GARBAGE BY-LAW Ihe Council of the Swan Lake Band of Indians at a meeting held this 22 day of Aiugust/77 hereby enacts by-law number 1-77 to provide for the regulation of the disposal of garbage and waste within the boundaries of the Swan Lake Indian Reserve* Whereas paragraph (a) and (r) of Section 81 of the Indian Act empowers the Council of a Band to make by-laws to provide for the health of residents on the Reserve and to prevent the spreading of contagious and infectious diseases and the imposition of a penalty for a violation thereof, and, Whereas it is deemed to be expedient to Control the disposal of garbage and. waste for the health and welfare of the inhabitants of the Swan Lake Indian Reserve. Now therefore the Council of the Swan Lake Band of Indians enacts as a by-law thereof the following: 1. In this by-law, (a) "Council" means the Council as defined in the Indian Act of the Swan Lake Band of Indians; (b) "Reserve means the tract of land set apart by Her Majesty within the definition of the Indian Act, for the use and, benefit of the Swan Lake Band of Indians knoxm as the Swan Lake Reserve. (c) "Premises" means land and residences within the Reserve. 2. No person shall accumulate or permit to be accumulated upon premises in his possession or deposit or accumulate on premises in possession of another person anything which is or may become offensive or injurious to health. 3. No person shall deposit any dead animal, offal fish, manure, garbage, fruit, vegetables, night soil, filth, liquid waste, human excretion, or anything of a nature which is or may become offensive or prejudicial to health upon or into any highway, street, road, alley,lane, lot, ditch, wharf, dock, pond, river, stream, well, or sewer or into and premises x^ithin the Reserve and any such deposit shall be deemed a nuisance, provided, however, that the provision of this paragraph shall not apply to the deposit and proper disposal of any such xvaste and material into or at a place within the Reserve approved by the Council for that purpose. 4. The Council may arrange for a regular removal of garbage and waste from any premises within the Reserve. 5. In the spring of each year, as soon as the melting snow permits the person residing in any premises x^ithin the reserve shall collect all Xvaste matter lying thereon including tin cans, bottles, paper and animal manure. 6. All such xvaste matter shall be disposed of In such a manner as will prevent any nuisance or offence as the fouling or polluting of wells and water supply. 7. Any person who violates any of the. provisions of this by-law shall be gull of an offence and shall be liable on a summary conviction of a fine not exceeding $100.00 or imprisonment for a term not exceeding 30 days or both fine and imprisonment.
