NOXIOUS WEEDS BY-LAW The f n c il of the Swan Lake Band of Indians at a meeting th is 22 day of August, 1977 heret, inacts by-law number 16-77 providing for the destruction and control of noxious L7T i P t 'V ip K n w rtrî n r*-? r> c? rvf- f~T> a Ct.ts» T o V o T n r ] i n n D ^ Whereas, paragraphs ( j ) and (r) of Section 81 of the Indian Act empowers the Council of a Band to make by-laws respecting the destruction and control of noxious weeds on the Swan Lake Reserve for the welfare of the inhabitants thereof. Now therefore the Council of the Swan Lake Band of Indians enacts as a by-law thereof, the follow ing: 1. ïn this by-law, (a) "Council means the. Council as defined in the Indian Act of the Swan Lake Band of Indians; (b) "Preserve" means the tract of land set apart by Her Majesty within the d efin itio n of the Indian Act, for the use and benefit of the Sx̂ /an Lake Band of Indians known as the Swan Lake Reserve, (c) "In sp ector" means the person appointed from time to time by the Council to be a xvreed inspector for the Reserve. (d) "Noxious Weed" means any p lant, that is harmful, damaging, in ju riou s, deadly and useless to man or domestic vegetation. 2. The occupant of any land within the Reserve sh all cut, or cause to be cut down, or otherwise destroy or cause to be destroyed a l l noxious weeds growing thereon as often as may be necessary to prevent them from going to seed. 3 . Any person who is a holder o f a c e r t if ic a te of usership sh all cut or cause to be cut allnoxious weeds groxving in ditches and on roads contiguous to land occupied. 4 . Any person xTho is a holder of a valid lease sh all cut and destroy or cause to be cut and destroyed a l l noxious weeds growing in ditches and on roads contiguous to land leased . 5. The Inspector sh all make periodic inspection of the Reserve. 6 . The Inspector may give w ritten notice to any occupant o f land within the Reserve, requiring that person to destroy or have destroyed any noxious x^eeds on that land within 7 days of receipt o f that person of that n otice . 7. An occupant, a iee see , or a holder of a c e r t ific a te of user ship who refuses or neglects to cut down or destroy the noxious weeds within the period of 7 days sh a ll be g u ilty of a breach of th is by-law. 8. Any person xvho v io la tes any of the provisions o f th is by-law sh all be gu ilty of an offence and sh all be. lia b le to a summary conviction to a fine, not exceeding $100.00 or imprisonment for a term not exceeding 30 days or both fin e and imprisoximent.
