Whereas pursuant to Section 85.1 of the Indian Act, The Council of the Red Sucker Lake Indian Band has authority to make by-laws respecting the prohibition of intoxication on the Reserve of the Band; A it n d de w s h i e r r e ea a s b le t he a nd C ou n n e c c i e l s sa o r f y Re f d o r Su th c e k er r eg La u k l e a ti I o n n d ia o n f t B h a e n d in co t n o s x i i d c e a r t s i on on the Reserve of the Red Sucker Lake Indian Band; Now therefore the Council of the Band with advice and consent e of n ac a t ma as j or f i o t l y lo w o s f ; the electors of the Red Sucker Lake Indian Band Definitions : 1. In this by-law, (a) "Band means the Red Sucker Lake Indian Band; (b) "Council means the Chief and Councillors chosen for the good government of the Band under Section 74 of the Indian Act or according to the custom of the Band; (c) "Reserve" means all the land, the legal title to which is vested in Her Majesty, that has been set apart by Her Majesty for the use and benefit of the Red Sucker Lake Indian Band, and includes any special Reserve; (d) "Intoxicant" means any substance which is an intoxicant within the definition of "intoxicants" for the purpose of the Indian Act. Prohibitions : 1. Any person who is intoxicated on the Reserve is guilty of an offence and is liable on summary conviction to a fine of not more than one hundred dollars or to imprisonment for a term not exceeding three months or to both fine and imprisonment. Assented by a majority of the electors of the Band who voted at a special meeting of the Band on August 28th, 1985 called by the Band Council for the purpose of considering this by-law. Any person who is himself or by any other person on his behalf, (a) sells, barters, supplies or gives an intoxicant to any person on the Reserve, or (b) Makes or manufactures intoxicants on the Reserve, is guilty of an offence and is liable on summary conviction to a fine of not more than one thousand dollars or to im­ prisonment for a term not exceeding six months or to both fine and imprisonment. 3. Any person who is found with any intoxicants in his possession on the Reserve, is guilty of an offence and is liable on summary conviction to a fine not more than one hundred dollars or to imprisonment for a term not exceeding three months or to both a fine and imprisonment. 4. Any person who keeps or causes intoxicants to be kept on the Reserve in any dwelling-house, building, tent or place is guilty of an offence and is liable on summary conviction to a fine of not more than one hundred dollars or to imprisonment for a term not exceeding three months or to both fine and imprisonment Exception : 5. Notwithstanding anything in the by-law, no person commits an w o h f i f c e h n ce i s u m nd a e n r u fa t c h t is u re b d y -l f a o w r m wh e o d ic s i u n p a p l l ie p s u rp o o r se p s o ss a e nd s se w s h ic i h n to is x ic p a o n s t s s e ssed or supplied for medicinal purposes.
