By-law #1991.3 of the Poplar River First Nation respecting Pets. WHEREAS the Council of the Poplar River First Nation desires to establish a By-law governing the protection against and prevention of trespass by domestic animals, in the Poplar River First Nation; and WHEREAS the Council of the Poplar River First Nation is empowered to make a By-law governing the protection against and prevention of trespass by domestic animals, and any matter ancillary thereto and the imposition of a penalty for the violation thereof pursuant to paragraphs 81(1)(e), (q) and (r) of the Indian Act. Now therefore the Council of the Poplar River First Nation hereby enacts as a By-law thereof as follows: 1. In this by-law, (a) "Council" means the Council, as defined in the Indian Act, of the Poplar River First Nations; (b) "domestic animal" and "animals" means and includes horses, cattle, dogs, or other simlar type of domestic animals; (c) "owner" shall include harbourer and possessor; (d) "running at large" means domestic animals not under the control of a'person or not within the confines of lands occupied or otherwise legally controlled by the owner. 2. All pets must be kept within the confines of the owner's yard; 3. In the event that the pet is outside of the owner's yard it must be chaperoned. 4. No owner of a domestic animal shall allow the same to run at large or trespass upon lands which are not lawfully in the personal possession of the owner of the domestic animal. 3. Any domestic animal found running at large for more than ten (10) days may be destroyed by the Band Constable. AND WHEREAS the violation of By-law #1991.3 upon summary conviction, may result in the impostion of a fine not exceeding one hundred dollars ($100) or a term of imprisonment not exceeding five days (5), or both, Be it known that this By-law entitled "Pets" is hereby enacted as By-law #1991.3 by the Council of the Poplar River First Nation at a duly convened meeting of the said Council held on the day of , 1991.
