BY-LAW NO. 5 A by-law to provide for the regulation of traffic in The Pas Indian Reserve, in the Province of Manitoba. The Council of The Pas Band of Indians at a meeting held this 20th day of November 1972 make the following by-law pursuant to paragraph (b) and paragraph (r) of Section 80 of the Indian Act. 1. In this by-law (a) "Council" means the Council of The Pas Band of Indians; (b) ' "Reserve" means The Pas Indian Reserve; (c) "Residential area" means any area in the Reserve designated by Band Council Resolution as a residential area for the purpose of this by-law; and (d) "School and playground zone" means any area in the Reserve designated by band council resolution as a school and playground zone for the purposes of this by-law; and (e) "Vehicle" means any wagon, cart, motor car, motor truck, trailer, motorcycle, traction engine tractor, roadmaking machinery or other conveyance that is driven, propelled or drawn by any kind of power. (f) "Road" means any road, bridge, driveway, street, lane, square, highway, avenue, parkway, viaduct, trestle, thoroughfare or other place set aside for, used, or open to the public for the passage of vehicles within the reserve. 2. (1) The council shall approve the design and dimension of traffic signs. (2) The council shall, by band council resolution, authorize the placing on any road of a traffic sign and the band council resolution shall specify the location of the sign. (3) The council shall place and maintain, or cause to be placed and maintained, the appropriate signs authorized on the portions of the roads affected by this by-law and shall remove or cause to be removed signs which are not authorized. .. .2
2 (4) No person shall interfere with or attempt to interfere with the placement or maintenance of any authorized traffic sign. (5) No person shall remove, deface, obliterate, alter or attempt to remove deface, obliterate, or alter or in any manner interfere with any traffic sign lawfully placed on a road. 3. No vehicle shall be operated on any road at a rate of speed in excess of 45 miles per hour and a sign to this effect shall be posted on all roads entering the reserve. 4. Notwithstanding the provisions of Section 2 hereto, no vehicle shall be operated on any road within a residential area at a rate of speed in excess of 30 miles per hour. 5. Notwithstanding the provisions of Section 2 and 3 hereto, no vehicle shall be operated on any road within a school and playground zone at a rate of speed in excess of 15 miles per hour. 6. Any person who violates any of the provisions of this by-law shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding ten dollars, or imprisonment for a term not exceeding seven days, or both fine and imprisonment. 7. By-law No. 2 passed by the Council of The Pas Band on the 6th day of December, 1955 is hereby repealed.
