By-Law No. 10 The Council of The Pas Band of Indians at a meeting held this 29th day of May, 1979, hereby enacts by-law number 10 to provide for the regulation of the disposal of garbage and waste within the boundaries of The Pas Indian Reserve. Whereas, paragraph (a) and (r) of Section 81 of The Indian Act empowers the Council of a Band to make by-laws to provide for the health of residents on the Reserve and to prevent the spreading of contagious arid infectious diseases and the imposition of a penalty for a violation thereof, and; Whereas, it is deemed to be expedient to control the disposal of garbage and waste for the health and welfare of the residents of The Pas Indian Reserve. Now therefore, the Council of The Pas Band of Indians enacts as a by-law thereof the following; 1. In this by-law; (a) "Council of the Band" means the Council of The Pas Band of Indians; (b) "Reserve" means the tract of land as defined in the Indian Act, (c) "Premises" means land and residences within the Reserve. 2. No persons shall deposit or accumulate or permit to be deposited or accumulated upon premises in his possession anything which is or may become offensive or injurious to health; 3. The Council shall arrange for regular removal of garbage and waste from any premises within the Reserve. 4. In the spring of each year, as soon as the weather permits, the person residing in any premises within the reserve shall collect or cause to be collected all waste matter lying thereon. 5. All such waste matter shall be disposed of in such manner as will prevent any nuisance or in accordance with the manner which the Council shall determine from time to time. 6. All garbage, which shall be removed on a regular basis from any premises, shall be kept in either a plastic or metal container, which is properly sealed. 7. No container or garbage and containers combined weight shall exceed 100 lbs. in weight. 8. Any person who violates any of the provisions of this by-law shall be guilty of an offence and shall be liable on a summary conviction of a fine not exceeding $100.00 or imprisonment for a term not exceeding thirty (30) days or both fine and imprisonment. Approved and passed at a duly convened meeting of the Council of The Pas Band of Indians this 29th day of May, 1979. A quorum for this Band consists of 5 Council members.
