WHEREAS in accordance with Section 81 . (1 ) of The Indian Act the council of a band m ay make by-laws for the preservation of life, safety, health and w elfare of people, protection o f property and protection of the environm ent;

AND WHEREAS the Council of the Nelson House First Nation has agreed to the necessity for a prompt and coordinated response to em ergencies;

AND WHEREAS it is deem ed expedient and in the public interest to adopt the provisions o f The Manitoba Em ergency M easures Act and to establish a plan, jointly with the Community of Nelson House, to provide a prompt and coordinated response to em ergencies.

NOW THEREFORE BE IT RESOLVED THAT THE COUNCIL OF THE NELSON HOUSE FIRST NATION ENACTS AS FOLLOWS :

INTRODUCTION Tit* contenu of this Emergency Plan, provide guidance for the Nelson House Indian Band to respond to an emergency.

This document will not prevent or reduce the possibility of an emergency occurring, It will aid in providing a prompt and coordinated response* thereby reducing human suffering and loss or damage to property and the environment.

The public must be informed about the Emergency Plan and educated as to certain dements (e.g. WARNING and EVACUATION procedures).

This Emergency Plan does not alter or over-ride the responsibility of Emergency Services (Police, Fire, Ambulance) to take warranted extraordinary action for the safety and well- being of the community, where time is of critical importance.

WHEREAS is accordance with Section S i.(i) of The Indian Act the council of a band nay make by-laws for the preservation of life, safety, health and welfare of people, protection of property and protection of the environment;

AND WHEREAS the council of the Nelson House First Nation has agreed to the necessity for a prompt and coordinated response to emergencies;

AND WHEREAS it is deemed expedient and in the public interest to adopt the provisions of The Manitoba Emergency Measures Act and to establish a plan, jointly with the Community of Nelson House, to provide a prompt and coordinated response to emergencies.

NOWTHEREFORE COUNCIL OF THE NELSON HOUSE FIRST NATION IN COUNCIL ASSEMBLED ENACTS AS FOLLOWS:

1. THAT The Emergency Measures Act, being Chapter E80 a( the Continuing Consolidation of the Statues of Manitoba, attached hereto as Schedule "A", shall apply to the Nelson House First Nation in a like manner as to a municipality of the Province of Manitoba.

2. THAT the attached Schedule "B" hereafter known as the Nelson House First Nation and the Community of Nelson House Emergency Plan and hereafter referred to as "the plan"

is hereby approved and adopted,

3. THAT the proper officers of the Nelson House First Nation are hereby authorized to implement the plan in accordance with the procedures agreed to and set forth in the pian.

4,0 im p l e m e n t a t io n 4,0.1 Emergency This Emergency Plan will be implemented in part or in whole, when Plan an emergency or a disaster has occurred or threatens to occur. Implementation will be authorized by: a) the Chief; b) in the absence of the chief, the Council; c) in the absence of the Chief and the Council, the Emergency Co-ordinator; or d) Emergency Services personnel authorized to act in accordance with this Plan.

5.0 ORGANIZATION AND CONTROL The structure, see Figure 1 (page #3), and responsibilities of command are follows:

5.0,1 Emergency Response Control Group a) Chief Shall direct and control the emergency operations at all times. (The presence of Federal and/or Provincial Emergency Response Teams does uot alter the Reserve's responsibility to direct and control the Emergency Operations within its jurisdiction.)

b) Council i) Assume responsibility in the absence of the Chief, ii) Participate with the Chief in the decision making process. Iii) Assist in direction of operations. c) Emergency i) Establish reliable communications between the operations Coordinator On-Site Commander and the Emergency Response Control Group. Ü) Keep the Chief and Council informed of developments as they occur. iii) Ensure all directions from the Chief and Council are carried out. iv) Direct Emergency Response Control Group Staff activities. v) Ensure annual updating of the attachments iu the Emergency Plan.

b) Clerks and Perform all duties Staff Administrator. 5.0.3 On-Site Emergency Response Operations Team In general, the On-Site Commander will be the Senior Police Officer, circumstances dictate otherwise.

b) Police In addition to their normal day-to-day duties, the police will provide: i) the On-Site Commander, unless circumstances dictate otherwise; ii) security at the emergency site; iii) a temporary Morgue if required; and iv) assistance in the evacuation of people. c) Fire In addition to their normal day-to-day duties, the fire service Services will provide: i) the On-Site Commander, when circumstances dictate otherwise; ii) assistance in the evacuation of people; and iii) initiation of Mutual Fire Aid if required. d) Emergency In addition to their normal day-to-day duties, emergency health Health services will provide: Services i) casualty evaluation; ii) initiation of Mutual Health Aid if required; iii) first aid on-site; and iv) casualty sorting and evacuation. 4

Federal assistance will be obtained through Indian and Northern Affairs Canada. Provincial assistance will be obtained through the Manitoba Emergency Measures Organization, only after local resources have been fully committed or when it is clear that local resources will be inadequate.

General Procedures Initially emergency services will respond beyond their capability to handle, Chief or, in the absence of the Chief, a member of the Emergency Response Control Group.

The Chief, or the Emergency Response Control Group member notified, will ensure all available members of the Emergency Response Control Group and Indian and Northern Affairs Canada are notified.

On implementation of the Emergency Plan, the Emergency Control Centre (Band Office or alternate location) will be staffed, communications to the emergency site will be established and the Emergency Response Control Group will assume

full responsibility for direction of the emergency response.

4.0 IMPLEMENTATION 4.0.1 Emergency This Emergency Plan may be implemented in pari or in whole, Plan excluding Subsections 4.0.2. to 4.0.5 inclusive, when an emergency or a disaster has occurred or threatens to occur (Subsection 9(2), Emergency Measures Act). Implementation may be authorized by one of the f ollowiug designees; a) the Minister of Northern Affairs;

4.0.2 Declared State In the event of an emergency or disaster, the Minister of Northern of Local Affairs, or in his absence, the Acting Minister may declare a State Emergency of Local Emergency for a period of 14 days from the date of the making thereof with respect to part or all of the community affected or likely to be affected by the emergency or disaster. (Subsections 11(1)), Emergency Measures Act)

4.0.3 Declaration Every declaration made under Subsection 4.0.2 shall be trans­to be scribed and shall include; Transcribed a) a description of declaration; b) identification of the part or parts of the affected by the emergency; c) the date and time the declaration shall take effect; d) a statement to the effect that all laws, regulations and orders shall be authorities shall be diligent in the discharge of their duties; and, e) a statement urging all citizens to comply with the laws and to co-operate with ail authorities.

4.0.6 Extension of A declaration made under Subsection 4,0.2. may, Declaration be extended with the approval of the Minister responsible for The Emergency Measures Act for further periods of 14 days each, in which case subsections 11(5), Emergency Measures Act)

4.0.7 Emergency Upon the declaration of, and during a State of Local Emergency, Powers the Minister of Northern Affairs, or in his absence, the Acting Minister of Northern Affairs may do everything necessary to prevent or limit loss of life and damage to properly or the environment

(Section 12, Emergency Measures Act), including any one or more of the following things;

a) utilize any real or personal property considered necessary to prevent, combat or alleviate the effects of any emergency or disaster; b) authorize or require any qualified person to reader aid of such type as that person may be qualified to provide; c) control, permit or prohibit travel to or from any area or on any road, street or highway; d) cause the evacuation of persons and the removal of livestock and personal property and make arrangements for the adequate care and protection thereof ; e) control or prevent the movement of persons and the removal of livestock from any designated area that may have a contaminating disease;

f) authorize the entTy into any building, or upon any land without warrant; g) cause the demolition or removal of any trees, structure or

crops b order to prevent, combat or alleviate the effects of an emergency or a disaster;

h) authorize the procurement and distribution of essentia] resources and the provision of essential services; i) provide for the restoration of essential facilities, the distribution of essential supplies and the mabtenance and co-ordination of emergency medical, social and other essential services; and, j) expend such sums as are necessary to pay expenses caused by the emergency or disaster,

(Subsection 15(1), Emergency Measures Act) 4.0.9 Termination The Minister responsible for The Emergency Measures Act may by Minister terminate the State of Local Emergency when, in his opinion, the emergency no longer exists and thereupon he will cause the details of the termination to be communicated by the most appropriate means to the Minister of Northern Affairs and the residents of the affected area. (Subsection 15(2), Emergency Measures Act)

4.1.0 Compensation Where as a result of action taken or done under subsection 4.0.3 a person suffers any loss of any real or personal properly, the Minister of Northern Affairs shall compensate the person for the loss in accordance with Section 13 of The Emergency Measures Act.

5.0 ORGANIZATION AND CONTROL The structure, see Figure 1 (page 10), and responsibilities of command are as follows:

5.Û.1 Emergency Response Control Group a) Mayor As Presiding Officer of the Community shall direct and control the emergency operations at all times. (The presence of Federal and/or Provincial Emergency Response Teams does not alter his/her

responsibility to direct and control the Emergency Operations within the Community.)

b) Community i) Assume responsibility in the absence of the Mayor Council ii) Participate with the Mayor in the decision-making iii) Assist in the execution of operational control.

c) Emergency i) Co-ordinate the emergency response. Co-ordinator ii) Prepare and co-ordinate emergency plans and programs. iii) Keep the Minister of Northern Affairs, the Mayor and/or Council informed of developments as they occur. iv) Ensure all directions from the Minister of Northern Affairs and the Mayor are carried out. v) Ensure reliable communications are established between the operations On-Site Commander and the Emergency Operations Centre.

vi) Ensure the Attachments to the Emergency Plan are amended as and when necessary and are revised and updated on an

annual basis.

ii) Secure the emergency site and/or evacuated area; iii) Establish a temporary Morgue if required; and iv) Assist in the evacuation of people.

b) Fire In addition to their day-to-day duties, the fire services will; Services i) Act as On-Site Commander, when circumstances dictate; ii) Assist in the evacuation of people; and iii) Initiate Mutual Aid (Fire) if required.

c) Ambulance In addition to their day-to-day duties, ambulance services will: Services i) Provide First Aid on-site; ii) Sort casualties and evacuate; iii) Initiate Mutual Aid (Health) if required.

OPERATIONS Policy The Community of Nelson House must depend entirely upon their own resources and the resources of neighbouring communities during the initial impact of an

emergency.

Provincial and/or Federal assistance will be obtained through the Manitoba Emergency Measures Organization, only after local resources have been fully

committed or when it is dear that local resources will be inadequate.

General Procedures Initially community emergency services will respond to an event. If this event is beyond their capability to handle, the Mayor or, in the absence of the Mayor, a member of the Emergency Response Control Group, will notify (he Regional Office

of Northern Affairs.

6.2.3 On implementation of the Emergency Plan, the Emergency Operations Centre (Community Office or alternate location) will be staffed, communications to the emergency site will be established and the Emergency Response Control Group will assume full responsibility for direction of the emergency response.

Sections 11(1) of the Emergency Measures Act Local Emergency. Such declarations can be authorities to take actions necessary to provide maximum protection to people, property and the environment. The declarations must be timely and one of the aims of the Act is to permit municipalities to act quickly.

It is a requirement that the essential details of a declaration must be communicated tu tiie Minister responsible for Emergency Measures as quickly as possible and confirmed forthwith in writing. Written declarations must contain the following informa lion.

Who is making the declaration? What is the nature of the emergency? What is the extent of the emergency? (In other words, what area is affected or likely to be affected?) When (date and time) is the declaration made?

A declaration form must record, at the very least, information answering the above questions. Attached is a sample of a recommended formats. This could easily be adapted and used for any situation, but it is important to note that the sample is recommended draft provided for convenience. The exact format and words need not be the only one used. Changes may be accepted, providing the above criteria are met. The Declaration of a State of Local Emergency must be communicated by the most expedient means to the public. Public notification of the State of Local Emergency should include the following:

- The reason for declaring a State of Local Emergency The area and/or extent of the emergency

An appeal to the public to obey authorities during the emergency - An appeal to the publie to stay clear of the emergency area - Assuring the public that all emergency response personnel in tiie dicharge of their duties.

$3.0 EVACUATION REQUIREMENTS 53.0. 1 GENERAL la the event it is necessary to evacuate people the procedures listed below must be observed.

53.0. 4 REGISTRATION AND INQUIRY All evacuees, whether providing their own transportation or utilising emergency transportation, will be instructed to register at a designated location. Information recorded will be utilized to answer inquiries regarding the safety and location or evacuees. 53.0. 5 SECURITY During the emergency evacuation period, police will establish and maintain security of the area evacuated.

53.1 RE-ENTRY PROCEDURES 53.1.1 Re-entry will be initiated as soon as possible but not before local, provincial and federal authorities are satisfied ail appropriate preparations have been nude (e.g. the restoration of utilities and essential services to homes and commercial establishments).
