ŸHathias Colomb Créé dation PHONE: 1 (204) S53-2089-2090 FAX: 1 (204) 553-2419 PU «AT A WAG AN, MANITOBA BOB 1GO No. 8 of tiie Mathias Colomb Band A By-law for the regulation of the conduct and activities of hawkers, peddlers or others who hawkers, pcddlcxs or others who enter the reserve to buy, sell or otherwise deal in warts or AND WHEREAS the Council uf the Muthios Colomb Band, also known as the Mathias Colomb Créé Nation is empowered to make such by-laws, and any matter ancillary thereto pursuant to paragraphs 81(1) (n), and (r) of the Indian, Act; AND WHEREAS k is deemed to be expedient and necessary, for the benefit, comfort and safety of the inhabitants of the Mathias Colomb Indian Reserve, to provide fur the regulation of the conduct and activities uf hawkers, pcddlcxs or others who eater die reserve to buy. sell or otherwise deal in waxes or merchandise; NOW THEREFORE the Council of the Mathias Colomb Band, also known as the Mathias Colomb C m Nation hereby makes the following by-law: \ activities of hawkers, peddlers or others who enter the reserve to buy, sell or otherwise deal in wares or merchandise; 2. In this by-law "Band’’ means the Mathias Colomb Band; "Minister" means the Minister of Indian Affairs and Northern Development; "Officer" means any police officer, police coos table or other person charged with the duty to preserve and maintain th* public pcict, and any person appointed by the Council lor the purpose
- 2 of maintaining law and order on the reserve. "reserve* m eans the reserve o f the Mathias Colomb Bawl and includes the M athias C olom b band R eserves N o. 198 and No. 199, "peddling" means to travel about selling goods. "merchandise" means goods that may be bought or sold in commerce; commodities. * t 3. (i) A person, other than a person referred to in subsection (2), who conducts on the reserve ( any of the following activities, namely: ^ (a) hawking or peddling of wares or merchandise; or (b) to buy, sell or otherwise deal in wears or merchandise. shall be deemed to be frequenting tlic reserve fur a prohibited purpose. (2) Subsection (1) does not apply to (à) a person who is a lawful resident of the reserve; or (b) ft person who, under a by~kiw of the Council, holds a valid licence to conduct any activity referred therein or is otherwise permitted to conduct that activity. 4. (!) An officer may order any person who does oat bold a valid licence to conduct any regulated activity or who is not a lawful resident of the reserve to leave the reserve immediately. (2) Where a person who has been ordered to leave the reserve fails or refuses to do so, an officer may take sucll reasonable measures os may be necessary to remove the person from the reserve. (3) No person shall foil or refuse to comply with an order made under subsection (1) to leave the reserve or interfere with an officer acting under subsection (2). 5. A person who violates way provision of this by-luw commits an offence and is liable on summary conviction to fine not exceeding $1000.00 or to imprisonment for • term not exceeding thirty days, or to both. MANITOBA ROB 1GO THIS BY-LAW IS HEREBY enacted at a duly convened meeting of the Chief and Council o f the Mathias Colomb Créé Nation this 22 day o f April 1997. Voting in favor of the by-law are the following members of die Chief and Cbuncil: -S = €hief being a majority of these members of the Chief and Council of the Mathias Colomb Band present at the aforesaid meeting of the Chief and Council.
