PUBLIC WATER SUPPLY BY-LAW The Council o f the Long P la in Band o f Indians at a meeting held th is 22 day of ust 1977 hereby enacts by-law number 4-77 to provide fo r the regu lation o f public water supplies w ith in the boundaries o f the Long P la in Indian Reserve, Whereas, paragraphs (a ) , (1 ), and (r ) o f Section 81 o f the Indian Act empowers th Council o f a Band to make by-laws to provide fo r the regulations o f the use o f public water supplies, and the imposition o f a penalty fo r a v io la t io n thereo f, and Whereas, i t is deemed to be expedient to provide fo r the regu lation o f the use o f public water supplies fo r the health, sa fety and w elfare o f the inhabitants o f the Long P la in Indian Reserve, Now therefore the Council o f the Long P la in Band o f Indians enacts as a by-law thereo f, the fo llow in g : 1. In th is by-law, (a ) "Council” means the Council as defined in the Indian Act o f the Long P la in Band o f Indians; (b) "Reserve” means the trac t o f land set apart by Her Majesty w ith in the d e fin it io n o f the Indian Act, fo r the use and b en e fit o f the Long P la in Band o f Indians known as the Long P la in Reserve, (c ) "Premises" means lands and residences w ithin the Reserve. 2. No person shall w i l fu l ly or m aliciously po llu te any w e ll, c is te rn , reservo ir or other water supplier w ithin the Long P la in Indian Reserve, in the Province o f Manitoba. 3. No person shall destroy or damage any w e ll, c is te rn , rese rvo ir , or other water supplier w ith in the Reserve. 4. The occupant o f a premise w ithin the Reserve shall keep any w e ll, c is tern or reservo ir thereon properly enclosed or covered. 5. No person shall deposit into or on the ic e o f or on the shores on any waters ly in g w ithin the Reserve any night s o i l , garbage, manure, dead animal matter, decaying vegetab le matter or any substance or substance which in any way may contaminate such waters and.tend to make the waters therefrom u n fit fo r human consumption, 6. Any person who v io la te s any o f the provisions o f th is by-law sha ll be gu ilty o f an o ffence and shall be l ia b le on a summary conviction to a f in e not exceeding $100.00 or imprisonment fo r a term not exceeding 30 days, or both fin e and imprisonment.
