HAWKERS & PEDDLERS The Council of the Long Plain Band of Indians at a neeting held this 22 day of August 1977 hereby enacts by-law number 14-77 to provide for the regulation of Hawkers and Peddlers within the boundaries of Long Plain Indian Reserve* Whereas paragraphs (n) and (r) of Section 81 of the Indian Act empowers the Council of a Band to make a by-law respecting the regulation of the conduct and activit of Hawkers and Peddlers and the Imposition of a penalty for a violation thereof, and Whereas it is deemed necessary to limit and control the activities of Hawkers and Peddlers for the benefit and welfare of the inhabitants of the Long Plain Indian Reserv Now therefore, the Council of the Long Plain Band of Indians enacts as a by-law thereof the following: 1 * In the by-law (a) "Council" means the Council, as defined in the Indian Act of the Long Plain Band of Indians; (b) "Reserve" means the tract of land set apart by Her Majesty within the definition of the Indian Act, for the use and benefit of the Long Plain Band of Indians known as the Long Plain Indian Reserve, ?c) "Vehicle" means any conveyance that is driven, propelled, or drawn by any kind of powers. (d) "Hawker & Peddler" means a person who swaps, traffics, buys, sells, barters, trades and deals in Wares or Merchandise and solicits his/her services. 2. No Hawker, Peddler or person shall enter upon the Long Plain Indian Reserve to go from place to place or to any house on any vehicle to buy, sell, trade, or deal in Wares or Merchandise without the written consent of the Chief and Council. 3. No person shall enter upon the Long Plain Indian Reserve to solicit the services to any member thereof without the written permission of the Chief and Council. 4. Any person who violates any of the provisions of this by-law shall be guilty of an offence and shall be liable on a summary conviction to a fine not exceeding $100,00 or imprisonment for a term not exceeding 30 days or both fine and imprisonment.
