CANADA Province of Ontario TO WIT I, STEPHEN ALFRED ROBERTS, residing at Ottawa, Ontario, make oath and swear that the paperwriting to which this affidavit is attached is a true copy of a document produced and shown to me and purporting to be the original by-law made pursuant to the Indian Act and signed by the Chief and Council of the Long Plain Band of Indians and dated August 22, 1977, the said copy having been compared by me with the said original document. CAMPING BY-LAW 1. Council of the Long Plain Band of Indians at a meeting held this 22 day of August 197/ hereby enacts by-law number 17-77 to provide for the regulation of access to camping areas and camping within the boundaries of the Long Plain Indian Reserve. Whereas, paragraphs (p) and (r) of Section 81 of the Indian A*ct empowers the Council of a Band to make by-laws to provide for the regulation of camping and the imposition of a penalty for a violation thereof, and, Whereas, it is deemed to be expedient to control and regulate camping areas within the boundaries of the Long Plain Reserve. Now therefore, the Council of the Long Plain Band of Indians enacts a by-law thereof the following: 1. In this by-law, (a) "Council11 means the Council as defined in the Indian Act of the Long Plain Band of Indians» (b) "Reserve" means the tract of land set apart by Her Majesty within the definition of the Indian Act, for the use and benefit of the Long Plain Band of Indians known as the Long Plain Indian Reserve (c) "Supervisor" means a person authorized by the Council of a Band to supervise camping areas and camping on the Reserve. (d) "Camping area" means a designated areas for temporary stop-overs, be it overnight or otherwise. 2. No person, other than a member of a Band or the holder of a valid camping lease, shall be permitted to camp or be In possession of camping equipment in the Reserve without first obtaining a written permit from the supervisor. 3. k camping permit shall be valid only for the period inscribed thereon and for such places in the Reserve as are designated as camping areas by the Council and may be subject to a fee established by Band Council Resolution. 4. All campers shall abide by the regulations of the Province of Manitoba made for controlling fires and the setting of fires in lands contiguous to the Reserve. 5. All campers shall make arrangements for obtaining firewood from the supervisor* 6. No timber, gravel or mineral shall be removed from the Reserve nor may trees be damaged in any way. 7. The Supervisor may cancel any camping permit where, in his opinion the holder of such permit has acted in a manner contrary to the best interests of the inhabitants of a Band, 8. No person shall without lawful excuse, the proof of which lies upon him, prowl or loiter by day or by night, upon or near the area where a campsite is located. 9» Any person who violates any of the provisions of this by-law shall be guilty of an offence, and shall be liable to a summary conviction to a fine not exceeding $100.00 or imprisonment for a term not exceeding 30 days or bo tb. f in e and irnpri sorunenr.
