PUBLIC WATER SUPPLY BYLAW TW Gouncil o f the Buffalo Point Band Members at a meeting held this 7 day o f July, hereby enacts bylaw number 3-81 to provide for the regulation o f public water supplies within the boundaries o f the Buffalo Point Reserve. Whereas, paragraphs. (a ) , (1 ), and (r) o f Section 81 o f the Indian Act empowers the Council o f a BAnd to make bylaws to provide for the regulations o f the use o f public water supplies, and the imposition o f a penalty fo r a v io la tion thereof, and, Whereas, i t is deemed to be expedient to provide for the regulation o f the use o f public water supplies fo r the health, safety and welfare o f the in habitants o f the Buffalo Point Reserve. Now therefore the Council o f the Buffalo Point Band Members enacts as a bylaw thereof, the follow ing: 1. In this bylaw, (a) "Council" means the Council as defined in the Indian Act o f the Buffalo Point Band Members ; (b) "Reserve" means the tract o f land set apart by Her Majesty within the d efin ition o f the Indian Act, for the use and bene f i t o f the Buffalo Point Band Members known as the Buffalo Point Reserve. (c) "Premises" means lands and residences with in Reserve. (d) "Cistern" means lands and residences with in Reserve. 2. No person shall w illfu lly or m aliciously pollute any w e ll, c is tern , reservior or other water supply within the Buffalo Point Reserve, in the Province o f Manitoba. 3. No person shall destroy or damage any w ell, c istern , reservior, or other water supply within the Reserve. 4. The occupant o f a premise within the Reserve shall keep any w ell, c istern , reservior or holding tank thereon properly enclosed or covered. 5. No person shall deposit into or on the ice o f or on the shores on any waters lying within the Reserve any night s o i l , garbage, manure, dead animal matter, decaying vegetable matter or any substance or substance which in any way may contaminate such waters and tend to make the waters therefrom unfit for human consumption. 6. Water w ill be supplied by an approved well on lo t or from public wells throughout the area. 7. Any person who violates any o f the provisions o f this bylaw shall be gu ilty o f an offence and shall be liab le on a summary conviction to a fine not exceeding one hundred dollars or imprisonment for a term not exceeding th irty days, or both fine and imprisonment.
