i a a j d i l /\w The Council of the Buffalo Point Band Members at a meeting held this 7 day of July hereby enacts bylaw number 2-81 to provide for the regulation and control of dogs within the boundaries of the Buffalo Point Reserve. Whereas, paragraphs (a) and (r) of Section 81 of the Indian Act em­ powers the Council of a Band to make bylaw to provide for the health of resi­ dents on the Reserve and to prevent the spreading of diseases and the inposition of a penalty for a violation thereof, and, Whereas, it is deemed to be expedient to provide for the regulation and control of dogs for the health, safety and welfare of the inhabitants of the in­ habitants of the Buffalo Point Reserve. Now therefore the Council of the Buffalo Point Band Members enacts as a bylaw thereof, the following: 1. In this bylaw, (a) "Council" means the Council as defined in the Indian Act of the Buffalo Point Band Members; (b) "Reserve" means the tract of land set apart by Her Majesty within the definition of the Indian Act, for the use and benefit of the Buffalo Point Band Members known as the Buffalo Point Reserve. (c) "Constable" means a person appointed for the purpose of main­ taining law and order on the Buffalo Point Reserve. (d) 'Household" means house-abode or any dwelling that is occupied. (e) "Beach" means the shore of the lake. 2. No person shall establish a kennel on the Reserve to breed dogs without the written consent of the Band Council. 3. All dogs within the boundaries must be leashed. 4. No household shall possess more than 2 dog/dogs at any one time. 5. A person or household that owns a dog with a vicious nature shall be responsible to keep that dog under control by having it muzzled or chained at all timesî 6. No person shall ill treat by beating, molesting or neglecting a dog that is tied, chained or otherwise. 7. No person or household shall possess a dog that is not properly collaret with a tag of ownership. 8. The Constable shall make periodic checks on the amount and kinds of dogs possessed in each household. 9. The Constable may by written order of the Council, destroy any stray dog that is not chained. 10. The Constable may by order of the Council give written notice to the owner of an undesirable dog within the Reserve requiring that person to get rid of the said dog, by any means within 7 days of receipt of n r: notice. 11. An owner of a dog who refuses or neglects the contents of a written notice within the period of 7 days shall be quilty of a breach of this by-law. 12. No person shall have or permit his/her dog on private or public beaches at any time.
DOG BYLAW Page 2 An person who violates any of the provisions of this bylaw shall be quilty -of an offence, and shall be liable to a summary conviction to a fine not exceeding one hundred dollars or imprisonment for a term not exceeding thirty days or both fine end inprisanent.
