FIREARM BY-LAW By-Law #1991.01 of the Little Black River First Nation respecting firearms. WHEREAS the Council of the Little Black River First Nation desires to establish a By-Law to provide for the regulation of firearms within the boundaries of the Little Black River First Nation; and WHEREAS the Council of the First Nation is empowered to make a By- Law regulating firearms and any matter ancillary thereto and the imposition of a penalty for violation thereof, pursuant to paragraphs 81(1) (c), (d) , (q), and (r) of the Indian Act. Now therefore the Council of the Little Black River First Nation hereby enacts as a By-Law thereof the following: 1. In this By-Law: (a) "Council" means the Council as defined in the Indian Act (b) "Firearm" means any make or calibre of rifle, shotgun, pistol, handgun, or any other barrelled weapon from which any shot, bullet, or missile can be discharged and that is capable of causing serious bodily injury or death to a person, and shall include but not be limited to air guns, BB guns, pellet guns, and cross bows. (c) MVehicle" mans any wagon, cart, motor car, motor truck, trailer, motorcycle, snowmobile, tractor, or other con­ veyance that is driven, propelled, or drawn by any kind of power. 2. No person shall carry a firearm concealed in his/her attire within the boundaries of the Little Black River First Nation. 3. All firearms carried in a vehicle within the Little Black River First Nation shall be kept inconspicuous at all times and in such a place and manner that no person will have immediate access. 4. No person shall upon any street, road, or inhabited area within the Little Black River First Nation discharge or attempt to discharge a firearm. 5. No person shall on the Little Black River First Nation actually or apparently under 16 years of age have in their possession or be allowed to handle or discharge or attempt to discharge a firearm without parental supervision. 6. Any person who violates any of the provisions of this By-Law shall be guilty of an offence and shall be liable to a summary conviction to a fine not exceeding $100.00 or imprisonment for a term not exceeding 30 days or both fine and imprisonment. 7. A parent or guardian who permits his/her child or ward to violate Section 5 of this By-Law shall be guilty of an offence and shall be liable to a summary conviction pursuant to Section 6 of this By-Law.
2 Be it known that this By-Law entitled "Firearm is hereby enacted as By-Law #1991,01 by the Council of the Little Black River First Nation of Indians at a duly convened meeting of the said Council held on the day of , 1991 being the majority of those members of the Council of the Little Black River First Nation of Indians present at the aforesaid meeting of the Council. A quorum of the First Nation is set at 2 members.
