-7— / d / o DISORDERLY CONDUCT & NUISANCE BY-LAW c d L 2 ~ -j S ^ ' 7 ' / r Th ou n c il o f the B ird ta il Sioux Band o f Indians at a meeting held th is 22nd day o f August 1977 hereby enacts by-law Number 7-77 to provide fo r the observance o f law and order and fo r the prevention o f d iso rd e r ly conduct and nuisance w ith in the boundaries t *ie Indian Reserve in the Province o f Manitoba. Whereas paragraph ( c ) , ( d ) , and (r ) o f S ection 81 o f the Indian Act empowers the Council o f a Band to make by-laws to provide fo r the law and order and the prevention o f d iso rd e r ly conduct and nuisance and the im position o f a penalty fo r a v io la t io n th e re o f, and Whereas i t is deemed necessary to m aintain law and order fo r the b e n e fit and w e ll being o f the inhabitants o f B ird ta il Sioux Reserve. Now th e re fo re the Council o f the B ir d ta il Sioux Band o f Indians enacts as a by-law th ereo f the fo llo w in g : 1. In th is by-law : (a) "C ou n cil11 means the Council as defin ed in the Indian Act o f the B ir d ta il Sioux Band o f Indians; (b) "R eserve" means the tra c t o f land set apart by Her M ajesty w ith in the d e f in it io n o f the Indian A ct, fo r the use and b e n e fit o f the B ir d ta il Band o f Indians known as the B ir d ta il Sioux Reserve. (c ) "C onstable" means a person appointed fo r the purpose o f m aintaining law and order on the B ir d ta il Sioux Indian Reserve. (d) "P u b lic P lace" means and in clu des anyplace to which the p u b lic have access as o f r ig h t or by in v ita t io n expressed or im plied . 2. No person s h a ll cause a d isturbance in or near a public p la ce . (a ) by f ig h t in g , screaming, shouting, swearing, s in g in g , or using in su lt in g or obscene language; (b) by being in to x ica te d with any a lc o h o l ic stim ulant or drug, or (c ) by impeding or m olesting other persons. 3. No person sh a ll expose him self or h e rs e lf or cause an indecent e x h ib it io n in a p u b lic p la ce or commit any a ct in a p u b lic p la ce which o ffen d against p u b lic decency or ord er. 4. No person sh a ll l o i t e r in a p u b lic p la ce or in any way ob stru ct persons who are th ere . 5. No person sh a ll d istu rb the peace and qu iet o f the occupants o f a dw elling house by d isch arg in g fire -a rm s , shouting, swearing or using in su lt in g or obscene language or by other d iso rd e r ly conduct in or near a dw elling house. 6. No person sh a ll w ithout law fu l excuse, the proof o f which l i e s upon him, prowl or l o i t e r by day or by night upon or near the premises o f another person w ithout the occupants perm ission e ith er expressed or im plied. 7. 7. The Constable sh a ll have the power and au th ority to a rrest any person who v io la t e any o f the p rov is ion s o f th is by-law . 8. No person sh a ll r e s is t or w i l fu l ly ob stru ct a Constable in the execution o f h is duty or any person la w fu lly a ctin g in a id ing such an o f f i c e r . 9. No person sh a ll omit without reasonable excuse to a s s is t a Constable in the execu tion o f h is duty in a rrestin g a person or in preserving the peace a fte r having reasonable n o t ic e that he is required to do so. 10. Any person who v io la te s any p ro v is ion o f th is by-law sh a ll be g u ilty o f an o ffe n c e and sh a ll be l ia b le to a summary co n v ic t io n to a f in e not exceeding $100.00 or Imprisonment fo r a term not exceeding 30 days or both f in e and imprisonment.
