HAWKERS & PEDDLERS The Council o f the B ird ta il Sioux Band o f Indians at a meeting held th is 22nd day o f August 1977 hereby enacts by-law number 14-77 to provide fo r the re g u la tio n o f Hawkers and Peddlers w ith in the boundaries o f B ird ta il Sioux Reserve, Whereas paragraphs (n) and (r ) o f S ection 81 o f the Indian Act empowers the Council o f a Band to make a by-law resp ectin g the regu la tion o f the conduct and a c t iv i t i e s o f Hawkers and Peddlers and the im position o f a penalty fo r a v io la t io n th e re o f, and Whereas i t i s deemed necessary to l im it and co n tro l the a c t iv i t i e s o f Hawkers and Peddlers fo r the b e n e fit and w elfare o f the inhabitants o f the B ir d ta il Sioux Indian Reserve, Now th e re fo re , the Council o f the B ird ta il Sioux Band o f Indians enacts as a by-law th ereo f the fo llo w in g : 1, In the by-law (a ) "C ou n cil" means the C ou ncil, as d e f ined in the Indian Act o f the B ir d ta il Sioux Band o f Indians; (b ) "Reserve" means the tra c t o f land set apart by Her M ajesty w ith in the d e f in it io n o f the Indian A ct, fo r the use and b e n e fit o f the B ir d ta il Sioux Band o f Indians known as the B ird ta il Sioux Indian Reserve, (c ) "V e h ic le " means any conveyance that is d riven , p ro p e lle d , or drawn by any kind o f power * (d) "Hawker & Peddler" means a person who swaps, t r a f f i c s , buys, s e l l s , b a r te rs , trades and dea ls in Wares or Merchandise and s o l i c i t s h is /h e r s e r v ic e s , 2, No Hawker, Peddler or person sh a ll enter upon the Indian Reserve to go from p lace to p la ce or to any house on any v e h ic le to buy, s e l l , trad e , or deal in Wares or Merchandise w ithout the w ritten consent o f the Chief and C ouncil. 3 . No person s h a ll enter upon the B ir d ta il Sioux Indian Reserve to s o l i c i t the s e rv ice s to any member th ereo f w ithout the w ritten perm ission o f the Chief and C ou ncil. 4 . Any person who v io la te s any o f the p rov is ion s o f th is by-law s h a ll be g u ilty o f an o ffe n c e and sh a ll be l ia b le on a summary co n v ic t io n to a f in e not exceeding $100.00 or imprisonment fo r a term not exceeding 30 days or both f in e and imprisonment.
