DOG BY-LAW A y — sûû s . / S f ,7 / f The Council o f the B ir d ta il Sioux Band o f Indians at a meeting held th is 22nd day o f Aug ., 1977 hereby enacts by-law number 2-77 to provide fo r the re g u la tion and co n tro l o f dogs w ith in the boundaries o f the B ir d ta il Sioux Indian Reserve. Whereas* paragraphs (a ) and (r ) o f S ection 81 o f the Indian Act empowers the Council o f a Band to make by-law s to provide fo r the health o f resid en ts on the Reserve and to prevent the spreading o f d iseases and the im position o f a penalty fo r a v io la t io n th e re o f, and, Whereas, i t i s deemed to be expedient to provide fo r the reg u la tion arid co n tro l o f dogs fo r the h ea lth , sa fe ty and w elfare 6 f the inhabitants o f the B ir d ta il Sioux Indian Reserve. Now th e re fo re the Council o f the B ird ta il Sioux Band o f Indians enacts as a by-law th e r e o f, the fo llo w in g : 1. In th is by-law , (a ) “ C ou ncil” means the Council as defin ed in the Indian Act o f o f the B ir d ta il Sioux Band o f Indians; (b) "R eserve” means the tr a c t o f land set apart by Her M ajesty w ith in the d e f in it io n o f the Indian A ct, fo r the use and b e n e fit o f the B ir d ta il Sioux Band o f Indians known as the B ir d ta il Reserve. (c ) "C onstable" means a person appointed fo r the purpose o f m aintaining law and order on the B ir d ta il Sioux Indian Reserve. (d ) "Household” means, abode or any dw ellin g that is occu p ied . 2. No person sh a ll e s ta b lish a kennel on the Reserve to breed dogs w ithout the w ritten consent o f the Band C ouncil. 3. No person s h a ll a llow h is /h e r dog to run at la rg e w ith in the Reserve. 4. No household s h a ll possess more than 1 dog/dogs at any one tim e. 5. A person or household that owns a dog w ith a v ic io u s nature sh a ll be re sp o n s ib le to keep that dog under co n tro l by having i t muzzled or chained at a l l tim es. 6. No person sh a ll i l l trea t by beatin g , m olesting or n eg lectin g a dog that i s t ie d , chained or otherw ise. 7. No person or household sh a ll possess a dog that i s not p rop erly co lla r e d w ith a tag o f ownership. 8. The Constable sh a ll make p e r io d ic checks on the amount and kinds o f dogs possessed in each household. 9. The Constable may be w ritten order o f the C ou ncil, destroy any stray dog that is not chained. 10. The Constable may by order o f the Council g iv e w ritten n o t ice to the owner o f an u n d esirab le dog w ith in the Reserve requ ir in g that person to get r id o f the said dog, by any means w ith in 7 days o f r e c e ip t o f n o t ic e . 11. An owner o f a dog who re fu ses or n e g le cts the contents o f a w ritten n o t ic e w ith in the period o f 7 days sh a ll be g u ilty o f a breach o f th is by-law . 12. Any person who v io la te s any o f the p rov is ion s o f th is by-law sh a ll be g u ilty o f an o f fe n c e , and sh a ll be l ia b le to a summary co n v ic t io n to a f in e not exceeding $100.00 or imprisonment fo r a term not exceeding 30 days»'or both f in e and imprisonment.
