The Council of the Berens River First Nation, at a meeting held a t u h «i i s t _ o _ __ p d r a o V v i o d f e C f l o a r w .4 a _ me _ a _ n _ s _ ' _ _ t , people actually or apparently sniffing gasoline, glue or other such substance within the boundary of the Berens River Reserve. WHEREAS, Paragraphs (c), (d), and (r) of Section 81 of the Indian Act empowers the Council of a Band to make by-laws respecting the behaviour and conduct of Band members and the imposition of a penalty for the violation therefore; and WHEREAS, the sniffing of gasoline or glue or other such substances often results in disorderly conduct and nuisance; and WHEREAS, the Council of the Berens River First Nation (Band) deems it necessary to restrict such activities. THEREFORE BE IT RESOLVED, that the Council of the Berens River First Nation enacts by-law thereof the following: 1. In this by-law: (a) "Council" means the Council, as defined in the Indian Act, of the Berens River Indian First Nation; (b) "Reserve" means the tract of land set apart by Her Majesty within the definition of the Indian Act, for the use and benefit of the Berens River Indian First Nation known as the Berens River Reserve ; (c) "Person" means anybody on the Berens River Reserve land. 2. No person on the Berens River Indian Reserve shall purposely sniff gasoline or glue or any such substance containing intoxicating properties. 3. No person on the Berens River Indian Reserve shall be under the influence of sniffing gasoline or glue or any such substance containing intoxicating properties. 4. The parents or legal guardians of any person under the age of 18 years and who has violated the provisions of Section (2) or (3) of this by-law shall also be deemed to have committed an offence under this by-law. 6. Any person on the Berens River Indian Reserve found violating the provisions of Section (2) or (3) may be apprehended by a police officer or by whomever is authorized by the Band Council for a period of time not exceeding 12 hours. 7. Any person on the Berens River Indian Reserve found guilty of violating Section (2) or (3) or (4) or (5) shall be guilty of an offence and shall be liable on summary conviction to imprisonment for a term not exceeding 30 days.
