JflN 24 00 0 0 1 2 4 1 PICTOU LANDING BAND COUNCIL RESOLUTION BY-LAW NO.___________________ A BY-LAW RESPECTING EMERGENCY MEASURES 1. WHERES AS in accordance with Section 81.(1) o f The Indian Act the council of a Band may make by-laws for the preservation o f life, safety, health and welfare o f people, protection o f property and protection o f the environment. TITLE: 1.1 This by-law shall be known as and may be cited as the "Emergency Measures By-law". EMO TO BE ESTABLISHED: 2.1 The Chief and Council may establish an Emergency Measures Organization to be known as the Pictou Landing First Nation Band Emergency Measures Organization (hereafter know as the Band E. M. O.) PURPOSES/ OBJECTIVES: 3.1 The purposes and objectives of the Band E.M.O. in cooperation with the Provincial Emergency Measures Organization are as follows: 3.1.1 to plan for the continuity of the physical operation o f government o f the Band and to establish plans for the cooperation and mutual assistance among municipal governments in the event of a civil disaster or emergency; 3.1.2 to coordinate the emergency plans o f the Band for departments and services having immediate responsibilities in the event o f a local disaster or emergency and to prepare plans for public survival; 3.1.3 to work closely with other authorities o f the Bands neighboring communities and provincial authorities who have been assigned to comparable duties; 3.1.4 to conduct a public self-help education program related to disasters and other types of man-made and natural emergencies; and 3.1.5 to carry out similar work within the geographical area of the Band.
TWO BRANCHES: 4.1 The Band E.M.O. shall consist o f two branches to be known as the Executive Committee and the Plans and Operations Committee. EXECUTIVE COMMITTEE: 5.2 The Executive Committee shall have the following duties, powers and responsibilities: 5.2.1 to establish policy for the Band E.M.O.; 5.2.2. to appoint an Emergency Measures Co-ordinator for the Band E.M.O. as listed in 7.1.1; 5.2.3 to submit in its annual estimates, estimates o f expenditures for the operation and maintenance o f the Band E. M. O.; 5.2.4 when it considers an emergency to be of such magnitude, it may invoke a declaration o f a state of local emergency or the powers within the provincial EMO Act or Regulations. EMERGENCY PLANNING OFFICER: 6.1 The Emergency Measures Co-ordinator shall be the Chairman of the Plans and Operations Committee and shall be responsible for: 6.1.1 the implementation o f the policy as formulated by the Executive Committee; 6.1.2 the fulfilment o f the purposes and objectives as more particularly set out in Section 3 o f this by-law; 6.1.3 to direct Emergency Operations; and 6.1.4 the performance o f other related duties as directed by the Executive Committee. PLANNING COMMITTEE: 7.1 The Plans and Operations Committee shall consist o f the following: 7.1.1 The Emergency Measures Co-ordinator as Chairman; 7.1.2 such o f the following as are appointed within or functioning on behalf o f the Band: Band Manager Fire Chief Chief o f Police/Native Constable Social Services Officer
Education Officer Transportation Officer Community Health Officer Public Works Supervisor Band Clerk Band Membership Officer Public Information Officer Volunteers/Volunteer Organizations Telecommunications Services SECRETARY 7.2 The Chairman shall appoint a secretary. CONSENT OF EMPLOYER: 7.3 When a member of the Plans and Operations Committee is an employee o f a Band, the consent of such Band shall be requested to make the appointment effective. RESPONSIBILITY OF PLANS & OPERATIONS COMMITTEE: 8.1 The Plans and Operations Committee shall be responsible for production and maintenance o f the Emergency Plan. POLICY DECISIONS 8.2 The Plans and Operations Committee shall, when decisions are required, submit the matter to the Executive Committee in the form o f recommendations. REPEAL: 9.1 All former Emergency Measures By-laws ofthe band are hereby repealed and this by-law substituted therefor. THIS IS TO CERTIFY that the by-law of which the foregoing is a true copy was duly passed at a duly called meeting of the Chief and Council o f the Pictou Landing Band o f Indians, day o f A.D., 2000.
