C 0 ? i BY-LAW 2B The Council of the Caughnawaga Band of Indians at a meeting held July 2, 1969, make the following by-law pur­ suit to paragraphs (c) and (r) of section 80 of the Indian Act. A by-law for the protection, preservation ana management o'f fur bearing animals, fish and Carrie on t-h I ndian Reserve No. 17 in the Province. of Quebec. 1 L*o n o r 53 o h , 0 f, h o t° J o r- H 1-, d ^ ll cl member of the faugh Oka Bands of Indians or Indians from other Bands accompanied by Caughnawaga or Oka Indians shall trap, fish, or hunt within the boundaries of the Doncaster Indian Reserve No. 17. 2. No member of the Caughnawaga or Oka Bands shall invite or accompany any person who is not a member of the above- mentioned Reserves for the purpose of trapping, fishing or hunting. ENFORCEMENT 3. The Chiefs and Councillors of the Bands, Indian constables Royal Canadian Mounted Police and any other person or Persons named by the Councils shall be ex-officio officers for the enforcement of this by-law. 4. Any officer for the enforcement of this by-law shall seize and bring all game and/or fish protected by this by-law along with any equipment by which such game and/ or fish were procured and shall make charge against violators before a police magistrate, stipendiary magistrate or person appointed by the Governor in Council to be a justice of the peace under the Indian Act, when:, (A) Such game and/or fish are found in the possession of any person other than a member of either of the above mentioned Bands. (B) Such game and/or fish are found in the possession, of any Indian who is not a member of either of the above mentioned Bands and who at the time of en­ ---/2
counter is not in the company of a member of either « of said Bands. (C) It is suspected that such game and/or fish have been taken through a violation of this by-law. Where a person is convicted of an offence under this by- lav;, the convicting court or judge may order that the game and fish, in addition to any penalty imposed, are forfeited to Her Majesty for the benefit of the band, provided, howeve onat the meat or fish so forfeited snail be delivered to a charitable institution designated by the Council. PENALTIES Any person who violated any of the provisions of this by-law shall on summary conviction be liable to a fine not exceeding one hundred dollars or imprisonment for a term not exceeding thirty days or to both find and im­ prisonment .
