WEED BY-LAW BLACKFOOT BAND #lti6 The Council of the Blackfoot Band of Indians at a meeting held on the Third day of September 19.58» makes the following by-law pursuant to paragraphs (j) and (r) of Section 80 of the Indian Act, BY-LAW NO. Cm A by-law to provide for the destruction and control of noxious weeds in Blackfoot Indian Reserve No, 146> in the Province of Alberta, 1* In this by-law, (a) ) "Noxious weeds" means perenial sow thisle, field bindweed, hoary cress, leafy spurge, Russian Knapweed, Canada thistle, hemp, blue lettuce, all members of the mustard family, false flax, shepherd1s purse, red root, stink weed, Russian thistle, ragweed, wild oats, Russian pigweed, blue bur, tumble weed, common barberry, toad flax, black-headed sunflower, corn spurry, couch grass, hedge bindweed, hemp nettle, cow cockle, white cockle, bladder Campion, tartary, buckwheat and downy brome grass# (b) "Inspector" means the Superintendent, the Assistant Superintendent or a person appointed or designated by the Council of the Band to enforce this by-law* (c) "Weed seed" yearns seed of. a noxious weed. Every occupant of land, or if the land is unoccupied, the owner, shall destroy all noxious weeds thereon as often in every year as is necessary to prevent the ripening of their seeds. 3» In order to search for noxious weeds or weed seeds 'an inspector at any time between sunrise and sunset may enter upon anv any land, and may enter any building other than a dwelling house, and may inspect any machinery, implement or vehicle. '"GO Where an inspector finds noxious weeds or weed seeds-; on any land he shall give notice in writing to the occupant, or if the land is unoccupied., to the owner, to destroy the noxious weeds or weed seeds within a - period of time specified therein, which period shall not commence-'until at least three days after the person named in the notice shall be served with a copy thereof,' (b) A notice shall be deemed to be served on the person named therein by leaving a copy thereof with an adult person at the usual place of residence of the person named therein or by sending it by registered post addressed to the person named therein at his usual place of residence. (c) If the person named in the notice fails to comply therewith, an inspector may cause the noxious weeds or weed seeds to be destroyed in such manner as he may deem proper# 2

The cost of destruction of noxious weeds or weed seeds found upon each parcel of land concerned shall be a charge against the occupant of the land, or if . it is unoccupied, against the owner thereof » 6 No person shall deposit or permit to be deposited any noxious weeds or weed «eeds in any place if to do so is likely to cause the weeds or weed seeds to grow or spread. ?. No person shall move or cause to be moved any vehicle, implement or machine used for threshing, seed cleaning chopping, baling or other processing of farm crops without first removing all seeds and other residue therefrom if to do so is likely to cause noxious weeds or weed seeds to spread. Every person who contravenes any provision of this by-law or who refuses or neglects to obey any lawful order of any inspector or interferes with or obstructs any inspector in the performance of his duties shall be guilty of an offence and liable on summary con­ viction to a fine not exceeding one hundred dollars or imprisonment for a term not exceeding 30 days or both fine and imprisonment.
