* 5 m -^1 THE LOUIS BULL BAND OF INDIANS #138B BY-LAW 85-1 Regulation of Traffic on Reserve
(2 ) PREAMBLE WHEREAS paragraph (b) and (r) of Section 81 of the Indian Act, R.S.C. 1970, c. 1-6 empower the Council of the Band to make by-laws respecting the regulation of traffic and the imposition of a penalty for the violation thereof; AND WHEREAS it is deemed to be expedient to limit the speed of vehicles on public roads for the safety and welfare of the inhabitants of the Reserve; NOW THEREFORE the Council of the Louis Bull Band of Indians #138B enacts a by-law thereof the following:
(3 ) 1. In this by-law: (a) "Council" means the Council of the Band, as defined in the Indian Act, of the Louis Bull Band of Indians #138b ; (b) "Reserve" means the tract of land, the legal title to which is vested in Her Majesty and set apart by Her Majesty for the use and benefit of the Louis Bull Band of Indians #138b (c) "Road" includes any road, bridge, driveway, street, lane, square, highway, avenue, parkway, viaduct, trestle thoroughfare or other place set aside for used, or open to the public for the passage of vehicles within the reserve; and (d) "Sign" or "Traffic Sign" means a sign, warning, marking or other device for the guidance or direction of persons using the roads. 2. The design, dimension and the erection of traffic signs shall meet the requirements indicated by the Council. 3. (1) The Council shall by Band Council Resolution auth­ orize the placing of all traffic signs and the resolu­ tion shall specify the location of the sign. (2) The Council shall place and maintain,or cause to be placed and maintained, the signs authorized by the Council and shall remove or cause to be removed, the signs which are not authorized by the Council. 4. No person shall interfere with or attempt to interfere with, the placement or maintenance of any authorized traffic sign. l 5. No person shall remove, deface, obliterate or alter / A \
(4 ) CONTINUED: (5) or in any manner interfere with any sign lawfully placed on a road. 6. Any person who violates any of the provisions of this by-law is guilty of an offense, and is liable on summary conviction to a fine not exceeding one hundred dollars or imprisonment for a term not exceeding thirty days, or both fine and imprisonment. 7. Amendment or repeal of this by-law shall require a simple majority of Council, at a meeting called for the specific purpose of amendment or repeal, such amendment shall be forwarded to the Minister of Indian Affairs and r i f Northern Development for registration. 8. This by-law shall come into force on the date of final reading by Council.
