Certified J rue Copy BY-LAW NO. 14 . A Blood Band By-law providing for the protection of Public Peace Officers and Peace Officers engaged in the execu­ tion of legal duties. We, the Blood Band Council, a quorum existing, pass the folloxtfing by-law under the power vested in us by Section 81 (3), (3), (q) and (r) of the Indian Act, R.S.C. c.149, to provide for the observance of law and order, and the prevention of disorderly conduct and nuisances, at a duly convened meeting of the Blood Band Council. Everyone who: (a) assaults a public officer or peace officer engaged in the execution of his duty, or such person acting in aid of such officer; (b) assaults a person with intent to resist or prevent the lawful arrest or detention of himself or another person; or (c) assaults a person (1) who is engaged in the lawful execution of a process against lands or goods or in making a lawful distress or seizure, or (2) xtfith intent to rescue anything taken under a lawful process, distress or seizure, is guilty of an offence and is liable upon conviction to a fine not exceeding One Hundred Dollars ($100.00) or imprisonment for a term not exceeding thirty (30) days, or both, or upon the recommendation of the Director of Protection Services to per­ form a beneficial service to the Blood Band Community according to the following schedule: A reduction in fine for every hour of beneficial service at a rate based on federal minimum wage standards, or one (1) eight (8) hour day equals two (2) days of imprisonment. Persons performing a beneficial service shall be released on their o\-m recognisance but must report to the Director of Protection Services at the beginning and end of each service day. A person who fails to fulfill the required amount of bene­ ficial service shall be subject to the above maximum fine or imprisonment, or both, with no credit given for bene­ ficial service time. In this by-law: PUBLIC OFFICER means employees of the Blood Band including security, fire department personnel, and ambulance person­ nel and deputies. PEACE OFFICER meansBlood Band Police, R.C.M.P., Sheriff and deputies. ASSAULT means an unlawful intent to inflict corporal injury to another by force, or force unlawfully directed at another np rson . noder r.i r e« ims tanre« vhi r h create a f ear of 1mminen t peril, couled with apparent ability to carry out intention if not prevented. BENEFICIAL SERVICE means performing in a working capacity for the benefit of the Band. - 1 -
( ' By-Law No. 14, Continued: The above by-law, pursuant to Section 82 (2) of the Indian Act, R.S.C* c. 149 shall come into force forty (40) days after a copy thereof is forwarded to the Minister pursuant to Section 82 (1), unless disallowed by the Minister within that period, but the Minister may declare the by-law to be in force at any time before the expiration of the forty (40) day period* The Blood Band Council by posting at public places throughout the Blood Reserve the above by-law during the above- mentioned to all concerned* But if the Minister disallows the by-law the Blood Band Council shall give notice of such disallow- ment.
