Minister of Indian Affairs Ministre des Affaires and Northern Development M~W indiennes et du Nord canadien CANADA I, the Minister of Indian Affairs and Northern Development, HEREBY APPROVE, pursuant to section 83 of the Indian Act, the following bylaw made by the Cowichan Indian Band, in the Province of British Columbia, at a meeting held on the 9" day of May 1995 . COWICFiAN INDIAN BAND Property Assessment and Taxation Amendment Bylaw No . 1 Whereas the Cowichan Indian Band passed the Property Assessment and Taxation Bylaw April 19, 1994 which was duly approved by the Minister of Indian Affairs and Northern Development pursuant to Section 83 of the Indian Act . And Whereas the Cowichan Indian Band deems it advisable to amend the Property Assessment and Taxation Bylaw in order to comply with the requirements for the establishment of institutionally independent appeal tribunals as set out in the "Matsqui" decision . Now Therefore the Cowichan Indian Band Council enacts as follows : 1 . This Bylaw be cited as the "Property Assessment and Taxation Amendment Bylaw No . 1 1995 ." 2 . The following sections are to be inserted following Section 55 in the Property Assessment and Taxation Bylaw : Section 55(a) Chief and Council will appoint each member of the Board of Review for a term of Two (2) years . Section 55(b) The appellant and any member of his or her immediate family is disqualified from sitting as a member of the Board of Review hearing the appeal . Section 55(c) A member of the Board of Review must declare any potential conflict of interest and withdraw from any hearing where a conflict of interest may arise . Section 55(d) Where a member of the Board of Review resigns or is otherwise unable to complete his or her term, Chief and Council will appoint a person to replace the member for the balance of the term . Section 55(e) Chief and Council will dismiss a member of the Board where : (a) The member failed to declare a conflict of interest in a matter before the Board ; or (b) The member failed to attend 3 consecutive appeal hearings ; or
(c) The member breached the duties set out in section 55(b) of this bylaw . Section 55(f) Every member will be remunerated at a rate of $300 .00 per diem for time spent on board activities . Section 55(g) The Chairman will be remunerated at a rate of $350 .00 per diem for time spent on board activities . Section 55(h) Chief and Council will re-imburse members of the Board of Review for reasonable and necessary expenses incurred in carrying out their duties . 3 . This bylaw shall be construed as being remedial and shall be given such fair, large and liberal construction and interpretation as best insures the attainment of its objectives . 4 . This bylaw shall come into force immediately upon being approved by the Minister .
