SQUAMISH INDIAN BAND PROPERTY ASSESSMENT BYLAW AMENDMENT BYLAWNO. 1 - 2002 WHEREAS: A. It is the practice of the Band Council of the Squamtsh Indian Band to enact a bylaw, annually, establishing rates of taxation to be applied to the assessed value of interests in land in certain of its reserves ; B. It is an objective ofassessments conducted under the provisions of the Squamish Indian Band Property Assessment Bylaw to ensure uniformity in the method of assessment of interests in land; C. The Band Council ofthe Squamish Indian Band wishes to further amend the Squamish Indian Band Property Assessment Bylaw to ensure that the objective set out in Recital B is given effect . NOWBE IT HEREBY RESOLVED that the following Bylaw be and is hereby enacted for the purpose of amending certain provisions ofthe Squamish Indian Band Property Assessment Bylaw as hereinafter provided . Short Title 1 This bylaw may be cited as the Squamish Indian Band Property Assessment Bylaw, Amendment Bylaw No . 1 - 2002. Amendment 2 The Squamish Indian Band Property Assessment Bylaw December 16, 1992, as amended to December 12, 2002 is amended as follows: (a) in subsection 1 .(1) by adding the following definition immediately after the definition for "taxes" : "telecommunications" includes land and improvements used or held for the purposes of, or for purposes ancillary to, the business ofa telecommunications common carrier that operates a telephone system, data telecommunications network or cable television undertaking, but does not include the land and improvements in respect ofa telecommunications common carrier that is a radio or television broadcasting or rebroadcasting undertaking. - 2 -(b) in subsection 1 .(2)(k) by adding "broadcasting, rebroadcasting" immediately after "telecommunications,", Tense 3 Where a provision in this bylaw is expressed in the present tense, future tense or in the past tense, the provision applies to the circumstances as they may from time to time arise without reference to the present tense, future tense or the past tense. Bylaw Remedial 4 This bylaw shall be construed as being remedial, and shall be given such fair, large and liberal construction and interpretation as best ensures the attainment of its objectives . Head Note 5 Head notes, marginal notes and provision headings form no part of this bylaw but shall be construed as being inserted for convenience of reference only . Severance of Sections 6 A finding by a court ofcompetent jurisdiction that a section or provision ofthis bylaw is void or invalid shall not affect or bear upon the validity or invalidity ofany other section or part ofthis bylaw or this bylaw as a whole. Coming into Force 7 This Squamish Indian Band Property Assessment Bylaw, Amendment Bylaw No. 1 - 2002 shall come into force and effc°.ct immediately upon approval by the Minister of Indian Affairs.
