WHEREAS,
A. The Squamish Nation Council (“Council”) deems it to be in the best interests of the Squamish Nation to regulate the use of land within Kitsilano Indian Reserve #6 (the "Reserve").
THEREFORE, BE IT RESOLVED:
1. Council, at a duly convened meeting, approves and passes the attached Squamish Nation Senakw Zoning By-law 2022, pursuant to section 81(1) of the Indian Act, R.S.C. 1985, Chapter I-5.

SQUAMISH NATION SENAKW ZONING BY-LAW 2022
(BYLAW NO. 1, 2022)
WHEREAS the Council of the Squamish Nation deems it to be in the best interests of the Squamish Nation to regulate the use of land within Kitsilano Indian Reserve #6 (the "Reserve").
NOW THEREFORE the Council of the Squamish Nation at a duly convened meeting assembled on the 20 th day of October, 2022, hereby enacts, pursuant to section 81(1) of the Indian Act, R.S.C. 1985, Chapter I-5, as a By-law the following:
1. This By-law may be cited as Squamish Nation Senakw Zoning By-Law 2022.
2. No portion of the lands within the Reserve shall be used for any purpose other than for First Nation cultural use.
3. Notwithstanding paragraph 2 of this By-law, any other purpose for which any portion of the Reserve may be used must be set out in a Zoning Bylaw Implementation Plan that has been approved by the Band Council. There is no certainty as to what specific uses or other particulars a Zoning Bylaw Implementation Plan may allow or may include and there is no certainty that a Zoning Bylaw Implementation Plan will be approved by the Band Council.
4. For the purpose of this By-Law, a “Zoning Bylaw Implementation Plan” means an implementation plan prepared with respect to a portion of the lands within the Reserve that sets out, at a minimum, the allowed uses on such portion, and meets the criteria set forth in Schedule A.
5. The Squamish Nation Senakw Zoning Bylaw enacted on October 29, 2020 is hereby repealed in its entirety.

Schedule A Implementation Plans
Each Implementation Plan prepared pursuant to this By-law will include details in respect of:
A. the aggregate gross floor area to be constructed; B. the uses of the buildings to be constructed, and the gross floor area and location of each such building;
C. any improvements proposed or required to be constructed by a developer; D. the amount of any non-market residential housing; and E. the estimated timetable and schedule for construction, including the estimated construction commencement and construction completion dates.
