3C&- 7\ .•' The Council of the Vest Bay Band of Indians at a meeting this S* day of h A V_____» 1968 make the following By-Law purusuant to paragraphs (G), / (E j jj j ya nd (R) o f » . S oetion 80 of the Indian Act* £ Whereas it is doomed expedient to regulate and eontrol building requirements within the Sewer and Water Areas and Whereas it is doomed expedient to regulate and control the use of land within the Sewer and Water Areas Therefore the Council of the West Bay Indian Reserre No* 22 enacts as follows: 1* In this By-Law (a) "band" means the West Bay Band of Indians (b) "Council" means the Council of the West Bay Band of Indians (c) "Owner" includes a person who occupies or resides on any lands as a locatee, tenant, licensee or permittee (d) "Front yard" shall mean the area from the street line to the front wall of the building or any portion thereof. (e) "Side yard" shall mean the area from the side line to the side wall of the building or any portion thereof* (f) "Outbuildings" shall mean garage, toolshed or any other building not used for the keeping of animals, fowl or excrements thereof or for human occupation* (g) "Rubbish" shall mean old automobiles or parts thereof, garbage or any other unsightly, odorous or offensive material* 2* No building shall be constructed on a lot in such a manner that (a) the minimum side yard clearance is not less than 8 feet* (b) the front yard set-back is not less than 25 feet nor more than 35 feet. 3* All newly constructed homes to hare poured concrete or concrete block foundations and shall conform to the existing minimum requirements of the Department of Indian Affairs and Northern Development. i 4* No outbuilding shall exceed 20 feet by sixteen feet in size unless the owner applies in writing to Council stating the need for such larger outbuilding at which time approval in writing from Council may be given* 5* All outbuildings shall oonform to the architectural, design of the home and Article 2 of this By-Law shall apply*
\ 2 « 6* No fence shall be constructed in excess of 4 feet and shall conform with the general surroundings to enhance the general neighbourhood* 7* Driveway culverts shall be installed with the construction of each new home where necessary* Such culvert shall be standard corrugated iron, a ainiim r̂n length of 16 feet and a minimum diameter of 15 inofces. Where longer culverts are required a space of 4 feet shall be left every 30 feet* 6* The owner shell ensure and shall be responsible far the proper elevation of the basement in regard to the existing or proposed main sewer elevation to ensure that all basement drains will be properly drained to the main sewer* The necessary information shall be procured before commencing excavation from the Sewer Commissioner* 9* Any infraction of this By-Law not rectified within 15 days by the owner after having received written notice so to do, shall be liable under Section 1C of this By-Law* 10* Any person convicted of a breach of any provision of this By-Law shall forfeit and pay at the discretion of the convicting Magistrate a penalty not exceeding (exclusive of costs) the sum of $50*00 for each offence*
